Charter Terms

1. Parties and scope

These Charter Terms apply to yacht charters in Croatia (Adriatic Sea) operated by Unbound Sailing d.o.o., Marina Frapa Resort, Uvala Soline 1, 22203 Rogoznica, Croatia, VAT HR34769294822 (the "Operator"). Bookings may be made through Charterwerk (the "Agent"). The charter contract is concluded between the charterer ("Charterer") and the Operator when the deposit is received and the booking is confirmed in writing. The vessel, dates, and services are listed in the booking confirmation.

2. Booking and payment

Prices are in EUR. A 50% deposit is due to secure the booking. The remaining 50% balance is due 30 days before embarkation. Payment can be made by bank transfer or card. If payments are not received on time, the Operator may cancel the booking and apply the cancellation terms.

3. Cancellation by Charterer

Cancellations must be in writing. Fees are calculated based on the date we receive the notice:

• 90+ days before embarkation: full refund
• 30-89 days before embarkation: 50% of the charter fee is retained
• Less than 30 days before embarkation: 100% of the charter fee is retained

Bank fees are non-refundable. If the charter is rebooked for the same period, the Operator may refund part of the fee at its discretion, minus costs.

4. Changes by the Operator

If the vessel becomes unavailable, the Operator may offer a comparable vessel or alternative dates. If no suitable alternative is accepted, payments received will be refunded. The Operator is not responsible for travel costs or other expenses.

5. Security deposit and damage waiver

A refundable security deposit of EUR 5,000 is required at check-in (payment or pre-authorization). It is refunded after inspection, minus damage, missing items, or fines. An optional damage waiver may be available on request; if purchased, the deposit may be reduced as stated in the booking confirmation. The damage waiver does not cover gross negligence, willful misconduct, or violations of these terms.

6. Crew and bareboat requirements

Bareboat charters are permitted only with a valid license accepted by Croatian authorities and proof of experience; the Operator may require a skipper if requirements are not met. Skipper and/or chef services are available for EUR 180 per day per person, subject to availability and confirmation at booking. Gratuities are not included.

7. Inclusions and exclusions

Unless otherwise stated in the booking confirmation, the charter fee includes: the yacht, standard onboard equipment, linens and towels, water toys, onboard Wi-Fi (subject to coverage), final cleaning, and yacht insurance. It excludes fuel, port/berth fees, provisioning, food and beverages, tourist tax, optional services, and special requests.

8. Check-in and check-out

Check-in is 16:00 and check-out is 09:00 at Marina Frapa, Rogoznica, unless agreed otherwise in writing.

9. Use of the vessel and conduct

The Charterer is responsible for guests and must comply with applicable laws, safety rules, and maximum capacity. The Operator or captain may terminate the charter for unsafe or illegal conduct without refund.

10. Itinerary and weather

Itineraries are subject to weather and safety. The captain or Operator may modify routes, ports, or timing as needed; no refunds are due for weather-related changes.

11. Insurance and liability

The yacht is insured according to Croatian law. The Charterer is responsible for personal belongings and is strongly advised to obtain travel and cancellation insurance. The Operator's liability is limited to the maximum extent permitted by law.

12. Taxes and fees

Tourist tax is paid separately by the Charterer via the official eVisitor system. Any additional government fees, if applicable, will be charged at cost.

13. Governing law and jurisdiction

These Charter Terms are governed by the laws of the Republic of Croatia. The court in Šibenik has exclusive jurisdiction.
